1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Bhumi Sewa mobile application (the "App") developed by Krishi Labs Pvt. Ltd. ("Krishi Labs," "we," "us," or "our"). By downloading, installing, or using the App in Nepal, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the App.
2. Age Requirement
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into this agreement under the laws of Nepal.
3. Grant of License
We grant you a non-exclusive, non-transferable license to access and use the App for your personal, non-commercial use only in Nepal.
4. Account Security
You are responsible for all activity that occurs under your account. You agree to keep your password confidential and secure and to notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your access to the App for any reason, at any time, without notice.
5. User Content
You may provide data related to your travel, food, energy consumption, waste generation, or other activities (collectively, "User Content") to the App for the purpose of calculating your carbon footprint.
You retain all ownership rights to your User Content. However, by submitting User Content to the App, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and translate your User Content solely for the purpose of providing and improving the App.
You are solely responsible for the accuracy and completeness of your User Content. You agree not to submit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or racially or ethnically offensive.
6. Third-Party Services
The App may integrate with or link to third-party websites, services, and content (collectively, "Third-Party Services"). We are not responsible for the content or practices of any Third-Party Services.
Your use of Third-Party Services is governed by the terms of service and privacy policies of those services.
7. Disclaimers
The App is provided "as is" and without warranties of any kind, express or implied. We disclaim all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee the accuracy, completeness, or reliability of any information or calculations provided by the App. You rely on such information at your own risk.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the extent permitted by the laws of Nepal, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold harmless Krishi Labs, its officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to your use of the App or your violation of these Terms.
10. Intellectual Property
The App and all intellectual property rights associated therewith (including copyrights, trademarks, patents, and trade secrets) are owned by Krishi Labs or its licensors.
You may not use any trademarks or service marks owned by Krishi Labs without our prior written consent.
11. Termination
We may terminate these Terms at any time, for any reason, with or without notice. You may terminate these Terms by deleting the App from your device.
Upon termination of these Terms, your right to use the App will cease immediately.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Nepal.
13. Entire Agreement
These Terms constitute the entire agreement between you and Krishi Labs with respect to the use of the App in Nepal.
14. Updates to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms
